Registration of Guyana Trademark 

Services offered include Searches, Registration of International and Guyana Trade Marks, Assignments, Change of Names and Addresses, Renewals of Trademarks and Oppositions.

Registration of Trade Marks are provided for by the Guyana Trade Marks Act Chapter 90:01 in respect of goods in Classes 1 to 34 from the date of application. International and Guyana Trademarks may be registered and Trademarks entered in the Register of Trade Marks in the United Kingdom may be re-registered. Registration gives exclusive right to the use of the Trademark in respect of the goods registered and protects the registered proprietor of the Trademark from any action for infringement and entitles the proprietor to bring an action for infringement. An action in Guyana for infringement of a UK-based registration can only complain of infringement that occurs after the date of registration in Guyana.

Services marks - Classes 35-45. Guyana does not provide for the registration of services marks unless they were previously registered in the United Kingdom.

Trademark Filing Requirements

For International (except UK) applications the following is required:

Name and address of applicant company registering the trademark

Name of the Trademark

Five original prints of the Trademark - logo or word

Class(es) and specification of goods excluding services marks

Original Authorisation to Agent in Guyana (Power of Attorney) in special format (notarisation and legalisation not required)

Translation if applicable.

For UK-based applications the following is required:

Name and address of applicant company registering the trademark

Name of the Trademark

Five original prints of the Trademark - logo or word

Class(es) and specification of goods

Original Authorisation to Agent in Guyana (Power of Attorney) in special format (notarisation and legalisation not required)

Certified copy of UK Certificate of Registration.

For the registration of a Guyana Trademark the following is required:

Name and address of applicant or company registering the trademark

Name of the Trademark

Five original prints of the Trademark - logo or word

Classes 1-34 and specification of goods

Original Authorisation to Agent in Guyana (Power of Attorney) in special format (notarisation and legalisation not required).

After filing - After the application to register a Trademark has been filed in the Registry, a number is issued. Searches of the Trademark and the classes are conducted among registered trademarks and pending applications in respect of the same goods or description of goods or any marks identical to the mark applied for or nearly resembling it. International convention priority is not available.

After the  searches and consideration of any evidence of the use or of distinctiveness or of any such matter which the applicant  may be  required to furnish, the  Registrar may accept the application absolutely or object or accept it subject to such conditions, amendments, disclaimers, modifications or limitations. Thereafter the documents are processed for advertisement and publication in the Official Gazette of Guyana inviting oppositions. If there are no oppositions, the Trademark is placed on the Trademark Register and the Trademark Certificate can be issued upon application. 

Registration of a Trade Mark is valid for a period of 7 (seven) years and may be renewed for a further period of 14 (fourteen) years.
