As in most European countries, registering a trademark in Estonia can be done either by filing an application request at national level or filing the registration request on a centralized European level, both methods offering the same amount of protection.

The trademark registration procedure is formed of the following main steps:
1. Checking the availability of the trademark in Estonia or Estonian Patent Search. This report will inform upon the probability of the trademark registration to be successful. The Examination looks for characteristics of the trademark application but also for similarity to other registered Estonian trademarks or European community trademarks. Also the examination looks into the confusion which might be created by the trademark with other Intellectual property, including but not limited to copyright or geographical origin denominations.
2. Filing the actual application for the Registration of the Trademark in Estonia (or the respective patent). The file will of course be processed beforehand by specialized Estonian Intellectual Property Lawyers.
3. Obtaining the confirmation of the successful registration of the trademark or patent in Estonia and subsequently obtaining of the Estonian Trademark Registration Certificate.

Trademarks registration in Estonia

Trademark validity time registered with the Estonian Patent Bureau is 10 years, afterwards renewable each time for a new 10 year period. State fee for a renewal is 192 EUR. For every more than one class of goods and (or) services for which the mark is registered the additional payment is 45 EUR per each.

Opposition against published marks may be submitted within 3 months from the publication date (state fee is 160 EUR).

Whole registration process of a trademark takes about 1 year, state fees payable are 141 EUR and 45 EUR for every additional class for filing and 45 EUR upon grant. "Likelihood of confusion or perception of mutual relation" is a principle applied in Estonia in determining if two marks may co-exist.

Further, the Customs authorities may be notified on registered marks, and in this way border control against counterfeited goods enforce, down to destruction of seized goods. Owners of trademarks may enforce their rights on removal infringing trademarks of unofficial distributors, traders, etc., from advertisement, documents, goods and services.
